Terms of Use
In short: LXP Cards helps you discover experiences and keep a record of the ones you have had. Your cards and photos stay yours. Be respectful, keep your password safe, and use your own judgment before trying any experience: the information in the app can be out of date, and activities are at your own risk.
1. Agreement
These terms are an agreement between you and LXP Cards, LLC, a New Jersey limited liability company ("LXP Cards", "we", "us"), for the website and app at lxpcards.com and the domains that forward to it (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. Who can use LXP Cards
You must be at least 13 years old. If you are under 18, you confirm that a parent or guardian has agreed to these terms for you. You may hold one personal account and must give accurate information when you sign up.
3. Your account
- Keep your password private and use one you do not use elsewhere. You are responsible for what happens under your account.
- Tell us right away at support@lxpcards.com if you think someone else has used it.
- You may stop using the Service and ask us to delete your account at any time.
4. Your content
"Your content" means the notes, photos, ratings, custom cards, suggestions and other material you add. You keep ownership of it. You give LXP Cards a limited, non-exclusive, royalty-free permission to store, copy, process and display your content only as needed to run the Service for you (for example, to save it and show it on your devices). If you send us a suggestion for the shared Directory of experiences, you also allow us to use, edit and publish that suggestion in the Directory.
You confirm you have the right to add what you upload, including photos, and that it does not break anyone else's rights or the law.
5. Acceptable use
Please do not:
- upload content that is unlawful, hateful, harassing, sexually explicit, or that shows or encourages harm to others;
- upload other people's personal information or photos without their permission;
- try to reach accounts or data that are not yours, test or get around our security, or overload the Service;
- copy the Service or its Directory in bulk, scrape it, or use automated tools against it;
- use the Service to send spam or for any unlawful purpose.
We may remove content or suspend or close accounts that break these rules.
6. Experiences, information and your safety
The Directory describes places, foods, events, traditions and activities around the world. We work to keep it accurate, but details such as dates, opening times, prices, rules and availability change, and some information may be incomplete or wrong. The Service is for inspiration and record-keeping only; it is not travel, legal, medical, safety or professional advice.
Before trying any experience, check current information with official sources, follow local laws and customs, and consider your own health, abilities and safety. You take part in any activity at your own risk. LXP Cards does not organize, sell or supervise experiences and is not responsible for third parties who provide them.
7. LXP points
LXP (Life Experience Points), rankings and similar features are for fun. They have no cash value, cannot be sold or exchanged, and we may change how they are calculated.
8. AI features
Some optional features use artificial intelligence, for example to suggest where a place is or to draft cards. AI answers can be wrong; check anything important before relying on it.
9. Other websites
The Service links to outside websites such as Google, Wikipedia, YouTube, Yelp and Tripadvisor. We do not control them and are not responsible for their content or practices.
10. Our content
The LXP Cards name, design, software and Directory (apart from your content and material credited to others, such as GeoNames place data under its CC BY 4.0 license) belong to LXP Cards. You may use them only to use the Service as intended.
11. Changes to the Service
We are improving LXP Cards all the time and may add, change or remove features. We may also suspend or stop the Service. If we plan to shut the Service down, we will give members reasonable notice and time to download their collections with Backup.
12. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not promise that the Service will always be available, error-free or that data will never be lost, so keep your own backups.
13. Limits on our liability
To the fullest extent the law allows, LXP Cards and its members, managers and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Service or any experience you take part in. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50. Some places do not allow these limits, so they may not all apply to you.
14. Your responsibility to us
If you break these terms or the law, or your content infringes someone else's rights, you agree to cover reasonable losses and costs that LXP Cards suffers as a result, to the extent the law allows.
15. Governing law
These terms are governed by the laws of the State of New Jersey, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New Jersey, and you and LXP Cards agree to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally. Nothing here limits rights you have under the consumer laws of the place where you live.
16. Changes to these terms
If we make important changes, we will update the date above and tell members in the app or by email before the changes take effect. Continuing to use the Service after that means you accept the updated terms.
17. General
If any part of these terms cannot be enforced, the rest stays in effect. If we do not enforce a term right away, we have not given up the right to do so later. You may not transfer these terms; we may transfer them to a new owner of the Service. These terms and the Privacy Policy are the whole agreement between you and us about the Service.
